Kumbe hii kazi yenu inakuanga risky.
Ikiwa hobby tu ni sawa but for commercial purposes, you always need backup, and cloud-based solutions are even better. And that back up should have a back-up for serious engagements. Wapiga picha hukapitia sana.

He won’t be the first or the last to feel aggrieved to such an extent that he litigates for redress.

The problem with these cases is not apportioning blame as it is always clear who failed in their contractual obligations but with allocating damages actually.

How much is enough to pay for their loss? Can you adequately be compensated for an experience?
Could they relive that event ever again with the same guests, weather, settings, ambience etc etc?
How much damages is sufficient to compensate them sufficiently?

Goes on to show just how important contracts are, even if it's a simple agreement with signatures appended and conditions well stipulated.
What if the photographer denies liability 🤔
What proof does the complainant have in the commercial/small claims court?

Absolutely.
Even if the Photographer fails in his duties, can you monetise the loss?
If one destroys an object, they can be asked to buy another one of similar and equal value.

How do you quantify funeral or wedding photos?
Can the Judge ask the Photographer to do it all over again as in building contracts?

Lakini pia, if there are large amounts involved, why didn't those people involve the services of an advocate?
