Embu court has fined a man Sh80,000 or serve one year in prison for stealing a woman’s underwear. According to court papers, Mugendi broke and entered a building used as a dwelling house by one Juliet Mawia and stole six inner pants valued at Sh1500.

She told the court it had rained and they followed the footprints to the house of the accused who she had known for more than 20 years as they lived in the same neighbourhood.

Na wewe metameta leta hekaya kamilifu. Zilukua mothers union? Nani alikua star witness? How was it proven beyond reasonable doubt that the exhibits belonged to only, and only the complainant?
 
He is lucky he was not caught in the act or responded with vayolence when the accuser caught him with her ngothas. That could be ground for robbery with violence and we all know the ultimate penalty for that offence.
Worse, if he squeezed any of her private parts in the scuffle, he could also face a sexual violence charge.
It is not the value of the stolen good that matters, ask @Mwalimu.

An Embu court has sentenced a father of two to a year in prison or a fine of Sh80,000 for stealing his neighbor's wife's underwear.
Pius Mugendi, 34, the accused, had denied stealing underwear on May 28 last year at Mikimbi village in Embu North sub-county.
Mugendi allegedly broke into a home used as a dwelling house by Juliet Mawira and stole six inner pants worth Sh1500, according to court documents.

Mawira told the court in chief that she awoke her husband at 3 a.m. on the material day because one of her garments had fallen near the window.
She went on to say that they discovered someone had broken into the compound around 11 p.m. after reviewing CCTV footage.
“As we reviewed the CCTV we noticed someone with a wire picking the innerwear and had a green paper bag and was trying to evade the CCTV but he was captured,” Ms Mawira submitted.
She told the court since it had rained and they followed the footprints to the house of the accused who she had known for more than 20 years as they lived in the same neighborhood.
The court found the prosecution had proven beyond reasonable doubt their case based on the evidence and exhibits tabled and Mugendi was put on his defense.
However, Mugendi submitted that he did not commit the offense as alleged and the complainant had likened him to somebody else in her CCTV.
In his mitigation Mugendi pleaded for leniency as he was the breadwinner of his family and sought court for forgiveness .
“Your honor I have a wife and children and pray for leniency from the court,” Mugendi pleaded in mitigation.
While sentencing the accused Embu senior resident magistrate Juliana Ndeng’eri in her ruling said the court had considered the mitigation.
The Magistrate said that so as it becomes a deterrent measure for others with such habit the court sentenced him to one year in jail or pay fine of 80,000 and has 14 days to appeal.
“The accused seems remorseful; however, he engaged in disrespectful and annoying act and the court fines him Sh80,000 or serve one-year imprisonment,” Ndeng’eri ordered
