It is not a crime, however, the Computer Misuse and Cybercrime Act has been misused terribly, especially by people who can bribe the police and judiciary. So, while not a crime, you are not assured of justice if you can't afford a high calibre lawyer or a significant bribe for the judiciary.

One is messing with someone's privacy, this has been judged.

Mambo ya kuwa na pesa or not is secondary; if he knew he didn't have money to bribe or hire a lawyer he should NOT have broken that law, PERIOD.

This is a follow-up to what I wrote above about an hour ago. I've researched the story.
The guy was jailed for trying to EXTORT/BLACKMAIL the lady who was with the seneta - 'nipeni pesa ama niwachilie hii picha ya shisha kwa mtandao'.
He readily admitted the count in court and was promptly jailed.
Mlikuwa mnataka court imwachilie because 'he's poor'.
