As long as the population keeps increasing in Kenya without proper planning for housing lazima land itakua encroached. What happened to the big 5 agenda.

Wouldn’t it be more prudent, cost-effective and humane to give a cease and desist Eviction Court Order?

Im not a lawyer so educate me here. Supposing I found Kazungu building a shack on my land. Do I have to get a court order to stop him and demolish it? Can he sue me for destroying his shack that's on MY land? Which law is that? I'm not asking a rhetoric question, nataka kujua.

I recall someone narrating to us how he dealt with a church that was refusing to vacate his land in the other village.

I do not have the particulars of that case. However, there is a difference between an undesired tenant and a squartter. For a tenant, I would use an agent or an auctioneer depending on the circumstances. Squatter akianza kujenga nabomoa hiyo kibanda faster faster. Let him move to court and sue me for damages if he wants to.

In order for someone to sue for something, they must have a vested interest in that object or land. If one has no personal stake in something, they can’t sue as they lack locus standi and the Courts won’t entertain their claims.

Since squatters have no ownership or other beneficial interest in your land, they have no grounds of suing.
A good analogy, @bigDog, if you allow my sense of naughtiness, would be you demanding conjugal entitlements from a stranger Girl who is not your Girlfriend or your wife! You would have no leg to stand on.

You as the owner of land can produce a title to prove ownership. As you well understand, a title to land is sacrosanct and irrefutable prove of ownership.

You as owner just need to give the squatters a 30 days notice to vacate. If they fail to comply you go to Court and apply for an Eviction Order.
When the Order is granted, the Police should move with speed to enforce the Order.
