EACC recovers grabbed public land along Mombasa road

The Ethics and Anti-Corruption Commission (EACC) has recovered grabbed public land valued at Ksh 430,000,000.
This after the Environment and Land Court, Milimani issued orders rectifying by cancelling the entries made in the grant and transfer in favour of the WAK limited and Redwood properties limited on 28/2/2001 and 30/3/2001 respectively and restoring the suit property to its reserved /planned and approved user.
The Court declared that the transfer of the grant to Redwood properties limited on or about 30/3/2001 was made fraudulently and illegally and is void and did not vest any lawful title.
Lady Justice Komingoi has now restrained Redwood properties limited, its servants or agents from alienating transferring charging or in any other manner dealing with the suit property.
The Court has also declared that the grant made to the WAK limited on or about 28/2/2001 was fraudulent and illegal and is void.
According to the EACC, the recovered land, parcel Number L.R. No. 209/6337 I.R. No. 85631 measuring approximately 0.8979 Ha, had been reserved as an interchange for Mombasa Road and Eastern Bypass (at Cabanas).
The suit was a culmination of investigations conducted by the EACC which established that land was government land and was therefore not available for alienation to the WAK limited and subsequent transfer to Redwood properties limited.
EACC told the court that the two perpetuated the fraudulent and illegal acquisition in collusion with Sammy Silas Komen Mwaita and S.K.W. Wangila.
